【禁聞】薄瓜瓜會不會被引渡回國

【新唐人2012年10月3日訊】在最近審理和公布的谷開來、王立軍和薄熙來案中,都或明或暗的提到了薄、谷二人的獨生子薄瓜瓜。特別是28號中共對薄熙來宣佈黨內極刑——雙開和移交司法處理後,中共是否引渡目前隱身美國的犯罪嫌疑人薄瓜瓜,備受世人關注。外界認為,引渡薄瓜瓜,對懲治那些把財產和後代轉移到海外,自己卻在國內為所慾為的中共貪官有好處,也符合法律規定,不過引渡高官後代,在無官不貪的中共社會似乎還行不通。


在谷開來殺人案和薄熙來涉嫌「家人收受他人巨額財物」的指控中,薄、谷二人的獨生子薄瓜瓜都是涉案嫌疑人,因此他是否會被引渡回國成為人們關注的焦點。

香港《明報》引用評論人士的分析說,中國與美國還沒有引渡合作,未來中國可能啟動司法協助程序,嚐試將薄瓜瓜帶回中國。

原大陸歷史學教授劉因全分析指出,在中共公布的材料中,谷開來因為薄瓜瓜殺害英國商人海伍德,王立軍因不願被薄瓜瓜招之即來而得罪谷開來,薄熙來案中又一次提到涉嫌「家人收受他人巨額財物」,劉因全說,因為在審理谷開來案中沒有提及經濟犯罪,這個所謂的「家人」又一次指向薄瓜瓜。

原大陸歷史學教授劉因全:「也就是說,薄瓜瓜是涉及到了這樣的刑事犯罪。如果涉及到了一個重大的案件,特別是涉及到了海伍德被殺案和國家巨額資產的洗錢案,中國政府完全可以將薄瓜瓜引渡回中國去。」

不過,劉因全認為,胡溫習一般情况下不會走出這一步。

薄瓜瓜上週六在社交網站Tumblr發表聲明,為薄熙來受到的指控鳴冤叫屈。

劉因全:「如果薄瓜瓜繼續像現在這樣為他爸爸媽媽鳴冤叫屈、顛倒是非、混淆黑白,為他爸爸媽媽這兩個罪犯鳴冤叫屈,我想倒楣的是他自己。中國政府完全可以通過正常的途徑把他引渡回國受審。」

中國政治學者陳子明也認為,出於對整個利益集團的保護,中共不會開「引渡高官子女」的先河。

劉因全:「開了這個先河以後,我認為是一個進步。我們知道,王子犯法與庶民同罪。你是紅三代,跑到國外來,把資金引過來就可以揮霍,自己的父母在國內當裸官,萬一犯了罪,即使他们受到了懲罰,兒女也沒事,如果這樣,不便於中國懲治貪官污吏。」

大陸律師張卉指出,從法律角度來看,薄瓜瓜涉嫌重大刑事案件應該引渡回國,不過薄瓜瓜在人們心目中只是一個花花公子,成不了氣候,中共可能不會花大力氣去引渡他,張卉說,整個案件政治色彩很重,不能單從法律的視野去解讀。

大陸律師張卉:「王子犯法與民同罪,中國是沒有這個理念的。薄瓜瓜這個事,還有牽一髮動全身這種感覺,一百個官員裡可能60個以上子女都在國外,把薄瓜瓜引渡回去,那你說在澳大利亞最豪華的海濱買的最豪華別墅的,這個大家都知道的,他的錢從哪來的?」

薄瓜瓜5月份從哈佛畢業後,仍然留在美國,雖然中美間並未簽署引渡條約,但他也不符合美國的難民申請資格,他未來的去留引人關注。

英國《每日郵報》引述消息人士的話稱,由於擔心牽涉各種腐敗指控,薄瓜瓜已經放棄從波士頓回到中國的計劃。《每日郵報》還引述一位薄瓜瓜熟人的話說,薄瓜瓜受到驚嚇,目前把自己隱藏了起來。

Will the CCP Extradite Bo Xilai's Only Son, Bo Guagua?

In recent trials and verdicts of Gu Kailai, Wang Lijun, and
Bo Xilai, one person repeatedly mentioned has been Bo and Gu's only son, Bo Guagua.
Especially on September 28, when the Chinese Communist
Party (CCP) announced their capital punishment verdict on
Bo Xilai—expelling Bo from the CCP and
transferring his case to judicial units.
Whether the CCP will extradite top suspect, Bo Guagua, who
is currently hiding in the U.S., attracts worldwide attention.
Some believe, extraditing Bo guagua is useful in punishing
corrupt officials who transferred properties and offspring
overseas, while doing whatever they wanted in China,
while also complying with the law.
But extradition of senior officials' offspring seems impossible
in a communist society where all officials are corrupt.

With Gu's homicide allegations and Bo Xilai's family
allegedly accepting huge amounts of others' properties,
Bo guagua, Bo and Gu's only son is a prime suspect
for corruption whether he'll be extradited back is a focus of attention.

Hong Kong's Ming Pao referred to commentators' analysis
that China and the U.S. have no cooperation in extradition.
In the future, China may start a judicial assistance program
to try to extradite Bo guagua back to China.

Liu Yinquan, a former history professor in China, pointed out
in CCP material that, Gu Kailai had killed Neil Heywood for the sake of Bo guagua.

Wang Lijun had offended Gu Kailai because he did not want to listen to Bo Guagua.
As for Bo Xilai's case, it was again stated that, “Bo's family
had accepted huge amounts of properties from others”.
Liu says, economic crimes were not mentioned in Gu's trial,
and this again points to family—to Bo Guagua.

Liu Yinquan: "In other words, Bo guagua is involved in such
major criminal offenses.
In a major case, especially like that of the Heywood homicide
and the money washing of huge national assets, the CCP can completely extradite Bo Guagua back through Interpol."

Liu says, Hu Jintao, Wen Jiabao and Xi Jinping
may not take this step.

Last Saturday (Sept. 29), Bo guagua issued a statement on
social networking site 'Tumblr', crying over Bo's allegations.

Liu Yinquan: "If Bo guagua continues to cry for his parents
for two criminals and cannot tell right from wrong, I think
it's he himself who will suffer; the CCP can extradite him
back to China on trial through normal channels."

Chinese political scholar, Chen Ziming, believes that the CCP
will not extradite senior officials' children, so as to protect the CCP's interest groups as a whole.

Liu Yinquan: "If the CCP starts to extradite officials' children,
I think it's a step forward.
If a prince was breaking the law, he should be sentenced
just the same as with commoners.
Bo guagua is a third generation CCP member who went
abroad to splurge national funds.
His parents are bare officials in China;
once they have committed crimes and have been punished,
if their offspring are not punished, this is not conducive to
punishing corrupt officials."

Chinese Lawyer, Zhang Hui, points out that Bo Guagua is
suspected in major criminal cases and should be extradited.
However, in the minds of most people, he is just a playboy
and cannot have great influence, so the CCP may not make great efforts to extradite him to China.
Zhang Hui says political overtones of the whole case are very
heavy; we cannot interpret it just from a legal point of view.

Lawyer Zhang Hui: “If a prince breaks the law, he should be
punished the same as commoners, but there are no such notions in China now.
Bo Guagua's trial will affect many others, because
over 60% of CCP officials have their children overseas.
Regarding extraditing Bo Guagua—the one who bought
the most luxurious house in Australia's most luxurious
beachfront villa—we all know now,
where did his money come from?"

Bo Guagua stayed in the U.S. since graduation from Harvard
University in May this year.
Although China and the U.S. have not signed an extradition
treaty, Bo Guagua is not eligible to apply for U.S. asylum, so his fate is a focus of attention.

The British Daily Mail quoted news sources saying that,
facing a variety of corruption charges,
Bo guagua has now abandoned his plan to leave Boston
and go back to China.
The Daily Mail quoted words from one of Bo Guagua's
acquaintances, saying that Bo guagua is fearful and in hiding.
